Psy Spark Inc. ("Psy Spark", "we", "us", or "our") provides marketing, lead generation, and landing‑page design services for professional service providers (including accountants). This Privacy Policy explains how we collect, use, disclose, and protect personal information in Canada, with a focus on compliance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta’s Personal Information Protection Act (PIPA).
Plain‑language summary: We collect basic contact details from people who ask us (or our clients) to get in touch. When a form is on a client‑branded page we operate, we collect on the client’s behalf and then forward the information exclusively to that client. We do not sell leads. You can unsubscribe or update your information at any time.

2) Scope
This Policy applies to:

our websites and landing pages that link to it;

our lead‑generation and marketing operations, including email and SMS outreach; and

client‑branded landing pages that Psy Spark designs, hosts, or operates.
This Policy does not cover our clients’ own websites or their independent handling of information once we forward a lead to them. For that, please see the client’s privacy policy.
3) What we collect
3.1 Information you provide directly

Contact details: name, email address, phone number.

Form content: your message and the service you’re inquiring about.

Consent records: your checkbox selection, timestamp, page/form version, and IP address (for audit/consent verification).
We do not ask for sensitive information (e.g., health, financial, or government ID numbers) on our lead forms.
3.2 Information collected automatically (websites/landing pages)

Technical data: IP address, device and browser type, pages visited, referral URLs, and time/date stamps.

Cookies and similar technologies: pixels, tags, analytics cookies, and advertising/retargeting cookies (see Section 10).
3.3 Business contact information
If you provide contact details in a business capacity (e.g., your work email and title), we treat them as personal information under this Policy and handle them responsibly. Certain business contact details may be treated differently under applicable laws, but we apply the same safeguards described here.
4) Why we collect and how we use personal information
We collect and use personal information only for reasonable purposes, including to:

Respond to inquiries and provide quotes at your request (phone, email, or SMS).

Forward your inquiry to the appropriate client (e.g., an accountant) when the form relates to that client and the page indicates the client’s brand.

Send commercial electronic messages (CEMs) (emails/SMS) about your inquiry, appointments, reminders, and—if you opt in—marketing updates (see Section 9).

Operate, maintain, and improve our websites, landing pages, and services (including analytics).

Ensure security and prevent abuse, including fraud and spam prevention.

Comply with law, enforce terms, and maintain records (including records of consent and unsubscribe requests).
We do not sell your personal information. Leads we collect for a client are exclusive to that client.
5) Our dual roles (Psy Spark vs. client‑branded pages)

Psy Spark‑branded pages. We collect and use your information as the primary organization responsible for it under PIPEDA/PIPA.

Client‑branded pages we operate. We collect your information on behalf of the named client and promptly forward it to that client. In these scenarios, the client is the primary organization responsible for your information once it is forwarded to them. Psy Spark acts as a service provider to the client. We may keep a limited copy (e.g., submission logs and consent records) for delivery confirmation, billing, quality assurance, fraud prevention, and to address complaints or legal obligations.
We enter into agreements with clients requiring them to: (i) use the information only for responding to your inquiry and related business purposes; (ii) comply with applicable privacy and anti‑spam laws; and (iii) honor unsubscribe/opt‑out requests we relay to them.
6) When and how we share information
We disclose personal information in these limited circumstances:

To the relevant client (e.g., a specific accountant) when your inquiry relates to that client or a page branded as that client.

To service providers who assist us in operating our business (e.g., hosting, analytics, CRM, email/SMS platforms, form capture tools). We use reputable providers and require them by contract to protect personal information and to use it only to provide services to us.

For legal and safety reasons, including to comply with laws, respond to lawful requests, protect our rights, safety, users, and the public, and detect/stop fraud or security issues.

Business transactions, such as a merger, acquisition, financing, or sale of assets, where permitted by law and subject to appropriate safeguards.
We do not sell personal information and we do not sell the same lead to multiple clients.
7) Where we store and process information (cross‑border transfers)
We are based in Canada but use cloud providers whose systems may be in other countries (for example, the United States, Ireland/EU, and Israel). As a result, your information may be transferred to or stored in jurisdictions with different privacy and data‑access laws. Where we use a service provider outside Canada to collect personal information (for example, a hosted form), we provide notice at or before collection and identify how to contact us about the service provider’s handling of personal information. We remain accountable for personal information handled by our service providers.

8) Retention & deletion
We keep personal information only as long as needed for the purposes described in this Policy or as required by law. Our standard retention periods are:

Leads collected for a client (client‑branded pages): submission and delivery logs, and associated consent/unsubscribe records—up to 90 days after forwarding to the client, unless needed longer to address delivery issues, disputes, fraud/security, or legal requirements.

Leads collected for Psy Spark: contact details, inquiry history, and consent/unsubscribe records—for the duration of your relationship with us and otherwise for up to 24 months of inactivity, after which we delete or de‑identify the records unless we need to keep them longer for legal or business purposes (e.g., audit, tax, security).

CASL consent/unsubscribe evidence: typically retained for up to 3 years after the last commercial electronic message (or after opt‑out) for compliance record‑keeping.
When records are no longer required, we securely delete them or de‑identify them. If you unsubscribe from our emails/SMS, we keep your email/phone on a suppression list so we don’t contact you again unless you re‑subscribe.
9) Email & SMS marketing (CASL compliance)
We send commercial electronic messages (CEMs) only in accordance with Canada’s Anti‑Spam Law (CASL):

Consent. We rely on your express consent (e.g., a checked box) or, in limited cases, implied consent (e.g., where you made an inquiry within the past 6 months).

Identification. Our CEMs identify Psy Spark and, where sent for a client, the client on whose behalf the message is sent. Messages include our valid mailing address and contact details.

Unsubscribe. Every CEM includes a clear, readily performed unsubscribe mechanism. We honor unsubscribe requests without delay and in any event within 10 business days.

Proof of consent. We maintain records of consent and unsubscribe requests.
Text messaging. If we send SMS, you can opt out at any time by replying STOP (or as instructed in the message). Standard messaging/data rates may apply.
B2B messages. Where a business‑to‑business exemption applies, we may send messages without consent; we still provide identification and an unsubscribe mechanism as a best practice.
10) Cookies, pixels & analytics
We use cookies and similar technologies to operate our sites, measure performance, and support advertising/retargeting. You can manage cookies in your browser settings. You can also:

Use AdChoices/DAAC tools to opt out of interest‑based advertising from participating companies.

Install the Google Analytics Opt‑out browser add‑on to limit Google Analytics data collection.
If you opt out, you may still see ads—they just may be less relevant. We do not knowingly place cookies on sites directed to children.

14) Changes to this Policy
We may update this Policy from time to time. When we make material changes, we will update the Effective date at the top and, where appropriate, provide additional notice (e.g., a banner on our site). Your continued use of our services after an update means you accept the changes.
15) Additional notices about client‑branded pages we operate
When we operate a page branded to a client, we will:

Clearly display the client’s name and branding.

State that Psy Spark operates the page and will forward your information to the client.

Include links to both the client’s privacy policy and this Policy.

Present a checkbox that collects express consent and identifies both Psy Spark and the client as potential senders of follow‑up messages.

16) Jurisdiction‑specific notes (Canada & Alberta)

We follow the fair information principles (accountability; identifying purposes; consent; limiting collection, use, disclosure, and retention; accuracy; safeguards; openness; individual access; and challenging compliance).

Alberta’s PIPA requires notice that personal information collected through a service provider outside Canada may be stored/processed outside Canada and how to contact us about our policies/practices. We provide that notice in this Policy and at the point of collection where appropriate.

If we cannot resolve it, you may have the right to complain to a privacy regulator, such as the Office of the Privacy Commissioner of Canada (OPC) or the Office of the Information and Privacy Commissioner of Alberta (OIPC). We will provide guidance upon request.

13) Severability
